Dutch foreign minister could raise Magnitsky sanctions issue with EU

Dutch Foreign Minister Uri Rosenthal has urged the Russian authorities to prosecute the officials responsible for the death of Hermitage Capital lawyer Sergei Magnitsky, the company said.

The Netherlands Foreign Minister Professor Uri Rosenthal has sent a report to the Dutch Parliament about compliance with the resolution made by the lawmakers in July this year, imposing sanctions against Russian officials in the Magnitsky case, according to the company’s press release obtained by Interfax on Thursday.

In the event of no acceptable results of the Russian inquiry into Magnitsky’s death, Rosenthal “will raise the matter of taking measures against the Russian officials in the Magnitsky case at the EU level, the press release said.

The Dutch minister said that the (Netherlands) government is concerned by the events related with the death of Magnitsky and supports the parliamentary resolution in this case, the company said. The minister urged the Russian investigative authorities to conduct an investigation with respect to the people who played a part in his death, and identify, prosecute and try those responsible, the company said.

Sergei Magnitsky, who was charged with tax evasion (a crime enshrined by Article 199 of the Russian Criminal Code), died in a Moscow detention facility on November 16, 2009. His death drew broad public response, both in Russia and abroad.

Larisa Litvinova, a doctor of the investigations detention facility Butyrka, was charged with manslaughter, and Dmitry Kratov, deputy head of the detention facility for treatment and prevention work, was charged with negligence.

Human rights are blaming Magnistky’s death on doctors and law enforcement officials. They believe that no real investigation was conducted into Magnitsky’s death despite dismissals in the Federal Service for the Enforcement of Punishments.

On July 5, the presidential human rights council provided to President Dmitry Medvedev the results of an independent investigation into Magnitsky’s death.
