Russian doctor cleared over Sergei Magnitsky death
Russia’s Investigative Committee said on Monday it had ended criminal proceedings against Larisa Litvinova because of a two year statute of limitations.
Magnitsky, then 37, died in a Moscow detention centre in 2009 after being beaten and denied adequate medical treatment. He had been arrested on what his colleagues say were trumped up tax evasion charges after he exposed an alleged $230 million fraud by interior ministry officials.
The Kremlin’s own human rights council found last year that Magnitsky, who worked for Hermitage Capital, a British investment fund, died as a result of “calculated, deliberate and inhumane neglect”.
Its report concluded that the lawyer had been denied vital treatment for gallbladder disease and pancreatitis.
While Russia’s president Dmitry Medvedev said last year that “criminal acts” played a part in the lawyer’s death, no one has been prosecuted for it.
Dr Litvinova, a doctor at the Butyrka detention centre in Moscow where Magnitsky was held, was charged in August with causing his death by negligence.
Her superior, Dmitry Kratov, was charged with negligence and is still under investigation.
Hermitage Capital called the decision to drop charges against Dr Litvinova “the latest example of the reluctance within the Russian government to hold anyone accountable” for Magnitsky’s death.
Magnitsky had alleged before his arrest that senior tax and police officials fiddled Hermitage paperwork in order to illegally take over the company’s subsidiaries and claim tax rebates which they pocketed.
The same police officers allegedly engineered his arrest as a means of stifling his revelation.
Last year, the criminal case against Magnitsky was reopened posthumously, supposedly to give his relatives a chance to clear his name.
