It is not time to normalize trade relations with Russia

The Obama administration should “go slow” on normalizing trade relations with Russia until Moscow shows it’s serious about curbing human rights abuses.

A key part of “normalization” is extending Permanent Normal Trade Relations (PNTR) status to Russia. This has been denied since 1974, when passage of the Jackson-Vanik Amendment barred the U.S. from granting that status to any country that restricts emigration.

Designed primarily to free Soviet Jews and other minorities from state repression, the amendment is largely non-responsive to conditions in post-Soviet Russia.

That’s why every American president, with the exception of Ronald Reagan, has routinely granted Moscow a waiver from the amendment since the collapse of the Soviet empire.

But that’s not to say that today’s Russia boasts a stellar human rights record. Indeed, basic rights, including the right to own property, are attacked persistently and systematically.

Why the Magnitsky Act Makes Sense

Senator John Kerry recently postponed—once again—the Senate Foreign Relations Committee’s consideration of the Sergey Magnitsky Act. This is wrong. Individual- and property-rights violations in Russia are undermining government legitimacy, destabilizing the country and preventing investment and business development—and the proposed Magnitsky Act can provide the tools to combat this sad state of affairs.

A weak rule of law and pervasive corruption—including the failing court and law-enforcement systems—are at the heart of these persistent rights violations, which reflect both the Soviet legacy and the older Russian tradition of the patrimonial state. Bad cops and courts are challenging everyday Russians, as well as Western and domestic investors. Top Russian leaders, including presidents Vladimir Putin and Dmitri Medvedev, have complained bitterly about the state of affairs but done little to improve things.

Now, Congress has a chance to press for trade reforms that are in the best interests of the United States while supporting the cause of human rights for all. The bipartisan bill was drafted in response to the death of Sergei Magnitsky. He died in detention following his whistle-blowing on massive fraud allegedly committed by Russian officials. It provides a practical and balanced way forward—something that can serve as a prerequisite for the lifting of the obsolete Jackson-Vanik Amendment, a 1974 restriction on trade with authoritarian regimes. The new Magnitsky Act would accommodate Russian membership in the World Trade Organization (WTO) while signaling long-term American commitment to the rule of law beyond Jackson-Vanik.

Promoting Human Rights in Russia Through the Sergei Magnitsky Act

Protection of basic human rights, including the right to own property, is an important issue for those who hold American values close to heart. In Russia, human and property rights violations are undermining the state and preventing investment and business development.

The poor state of the rule of law and pervasive corruption—including the failing court and law enforcement systems—are at the heart of persistent rights violations. They are challenging everyday Russians as well as Western and domestic investors. Russian top leaders, including both Presidents Vladimir Putin and Dmitry Medvedev, have bitterly complained about the state of affairs but did little to improve things.

Congress should press for trade reforms that are in the best interests of the United States while supporting the cause of human rights for all. The Sergei Magnitsky Rule of Law Accountability Act (S. 1039), and its sister legislation introduced in the House of Representatives, is drafted in response to the death of Sergei Magnitsky in detention following his whistle-blowing on massive fraud allegedly committed by Russian officials. It provides a practical and balanced way forward and accommodates Russian membership in the World Trade Organization (WTO) while signaling long-term American commitment to the rule of law.

Human Rights and the Sergei Magnitsky Case

Sergei Magnitsky was a 37-year-old attorney who uncovered a giant corruption scheme that involved embezzlements of $230 million from the Russian Treasury by law enforcement and tax officials. After making accusations, he was arrested on fabricated tax evasion and tax fraud charges.

Magnitsky died in isolation at a Russian prison where he was denied medical care and beaten mercilessly by guards; an investigation by the Russian Presidential Council on Human Rights has confirmed as much. This has not resulted in the punishment of those involved. Those that were in power remain in power, and some have even been decorated or promoted. Earlier this month, Russian state prosecutors dropped charges against the chief doctor at the prison where Magnitsky died after the statute of limitations expired. The physician had been accused of negligence resulting in Magnitsky’s death.[1] Other officials implicated in the affair have been promoted instead of being punished.

Anti-Russian Amendment Now Headache for U.S.

Economic sanctions against Russia imposed by the United States in 1974 could backfire on America this year, but are likely to stay in place because of persistent political and ideological grudges between the two Cold War rivals, analysts said.

The Jackson-Vanik amendment was defunct in practice over the last two decades, but things got tricky after Russia completed its 18-year-long path to the World Trade Organization (WTO) last year, with more than a little help from the White House.

WTO rules ban formal trade restrictions such as the Jackson-Vanik amendment, which means the United States could face economic sanctions from Moscow and pressure from WTO once Russia completes the treaty’s ratification, expected this summer.

“Russia has no practical interest in canceling the Jackson-Vanik amendment,” Konstantin Kosachyov, then-State Duma lawmaker with United Russia and deputy head of the international affairs committee at the lower chamber, said in late February.

The Failure of the “Russia Reset”: Next Steps for the United States and Europe

Abstract: The policies of the United States and the European Union should encourage and support Russian civil society and Russia’s democratic modernizers. And, if Russia continues to abrogate its international commitments to basic freedoms and human rights, the U.S. and the EU must stand up for democratic values and make it clear that Russian aggression will not be tolerated. President Obama’s Russia “reset” policy achieves the opposite. Just as the U.S. reset has shaped European thinking, overly lenient signals from the EU to Russia will have a negative effect on U.S. interests, including support of democracy and promotion of economic freedom. The U.S. should collaborate with individual European allies as well as the European Union to set an agenda that better defends transatlantic interests from Russian aggression.

President Barack Obama’s Russia “reset” policy has encouraged European Union politicians who have long advocated a “softly, softly” approach toward Russia to push for a “fast-forward” in Brussels’ relationship with Moscow. Clearly alluding to President Obama’s Russia-policy pronouncement at the EU–Russia summit in June 2010, President of the European Council Herman van Rompuy stated: “With Russia we do not need a ‘reset.’ We want a ‘fast forward.’”[1]

Russia Squanders Its Chance at Democracy

In late August, Russian president Dmitry Medvedev appointed Georgy Poltavchenko governor of St. Petersburg. Poltavchenko has served as presidential envoy to Russia’s central-administrative district since 2000. More importantly, he is a loyalist to Prime Minister Vladimir Putin and a KGB veteran. He replaces Valentina Matviyenko, another Putin confidante, who has moved on to chair the Federation Council, the upper house of the Russian Parliament. Sergey Mironov, the former speaker of the Federation Council, is out. All this game of musical chairs has little to do with either President Medvedev or significant democratic developments. Rather, it demonstrates how Putin is rearranging his insiders.

Planned in secret as early as July, Poltavchenko’s appointment highlights the deep gap between democratic rhetoric and practice in today’s Russia. Analyzing the move, Nikolay Petrov, the Moscow Carnegie Endowment regional-politics expert, sounded baffled:

If United Russia were suffering from low ratings in St. Petersburg and the unpopular Matviyenko was dragging the party even further down, why replace her with a gray, low-profile presidential envoy who has about as much charisma as State Duma Speaker Boris Gryzlov? For all of her shortcomings—and there were many of them—Matviyenko at least was a colorful and charismatic politician.

The Sergei Magnitsky Case: An Admission of Guilt

On July 5 the Russian Human Rights Council published its report on the now infamous—and mysterious—death of the lawyer Sergei Magnitsky. An attorney for the Moscow-based American law firm Firestone Duncan, he represented Hermitage Capital, which was at the time the largest Western hedge fund in Russia.

Magnitsky died while in custody awaiting trial for a fabricated tax evasion charge. He was jailed after he accused Russian officials of fraudulently obtaining $230 million in tax rebates from the Russian Treasury using a sophisticated swindle. These were the same officials who prosecuted Hermitage and barred its owner, Bill Browder, from returning to Russia for reasons the state refused to reveal.

Reset Regret: Moral Leadership Needed to Fix U.S.–Russian Relations

The discussion about democracy, human rights, and the rule of law has careened through at least three phases in U.S. relations with Russia, each one resulting in sometimes jarring shifts in Washington’s approach to Moscow.

In order to reaffirm America’s interests, when dealing with Russia, the U.S. should concentrate on the values of freedom and justice. The Administration needs to stop its policy of “pleasing Moscow” and instead add pressure on Russia to start a “reset” of its own policies that currently disregard human rights, democracy, and good governance. The U.S. should deny visas to corrupt Russian businessmen, examine their banking practices and acquisitions, and target Russian police and prosecutors who fabricate evidence, and judges who rubber stamp convictions, which is what the bipartisan S. 1039 “Justice for Sergey Magnitsky” bill aims to do.
