If the US Congress cares about human rights, it will replace Jackson-Vanik with the Magnitsky Act

The US House Committee on Foreign Affairs hosted a hearing yesterday that addressed human rights and corruption in Russia, and the future of US-Russian relations. The hearing paid particular attention to the Sergei Magnitsky Rule of Law Accountability Act (.pdf), currently under consideration by the US Congress, which seeks to impose travel bans and asset freezes against the individuals involved in the false imprisonment, torture and death of the whistleblower attorney Sergei Magnitsky. The act also carries a universal application against all individuals credibly suspected of human rights abuses.
The hearing highlighted one of the key issues facing contemporary US-Russian relations: how—or indeed, whether– the US can support human rights in Russia today. This question was embodied in the confluence of the debate over the Magnitsky Act and the proposed repeal of the Jackson-Vanik amendment.

The proceedings featured the testimony of Bill Browder, the CEO of Hermitage Capital who has spearheaded the campaign to bring the perpetrators of Sergei Magnitsky’s false imprisonment and death to justice. Sergei Magnitsky was an attorney employed to represent Hermitage Capital, who uncovered an elaborate ruse by government officials whereby Hermitage companies were fraudulently re-registered and used to apply for a tax refund of $230 million. Magnitsky went public with his accusations, and was subsequently pressured into confessing to the theft of the $230 million, and imprisoned without trial in November 2008.

Replace Jackson-Vanik With the Magnitsky Act

A number of opposition leaders — including myself, Boris Nemtsov, Alexei Navalny and others — recently made an appeal to the U.S. Congress. We proposed that Congress repeal the outdated 1974 Jackson-Vanik amendment and replace it with a tough Magnitsky act. The proposed law would allow the United States to target sanctions against more than 60 specific Russian politicians and officials who are directly responsible for the death of citizens, for illegally seizing the property of others and for falsifying elections.

Not everyone understood our position on Jackson-Vanik correctly — as if we had somehow become soft on Russia’s poor human rights record. They couldn’t be more wrong. Our position differs substantially from that of the administration of U.S. President Barack Obama, and even more from the position taken by Kremlin hard-liners. 

President-elect Vladimir Putin, in dealing with the West, would like to exclude any discussion of democracy, human rights and corruption. This would get in the way of the ruling elite’s main goals: to reap profits from the sale of the country’s natural resources and to transfer those funds into safe havens in the West.

Russia-US stand apart over Magnitsky bill

The US senate is considering a resounding rap on the knuckles to Russia, in a bill that went before Congress on Thursday, lambasting the rule of law in Russia and condemning a raft of officials whom supporters of dead lawyer Sergei Magnitsky accuse of corruption and complicity in his death.

A bipartisan bill sponsored by 15 senators proposes to again freeze the assets and block visas of individuals who Washington sees as committing gross human rights violations against Russian human rights activists.

The Russian foreign ministry said the bill was “regrettable,” RIA Novosti reported.

More senators oppose lifting trade sanctions on Russia

Four more senators joined the opposition to repealing the Jackson-Vanik trade sanctions law against Russia on Friday, unless that repeal is accompanied by a new law specifically targeting human rights violators inside the Russian government.

Sens. Ben Cardin (D-MD), Joe Lieberman (I-CT), John McCain (R-AZ), and Roger Wicker (R-MS) wrote a letter Friday to Senate Finance Committee heads Max Baucus (D-MT) and Orrin Hatch (R-UT) to let them know that they oppose Baucus’s effort to repeal the 1974 Jackson-Vanik law unless it is replaced with the Sergei Magnitsky Rule of Law Accountability Act of 2011 — legislation meant to promote human rights in Russia that is named for the anti-corruption lawyer who died in a Russian prison, after allegedly being tortured, two years ago.

Without repeal of the Jackson-Vanik law, U.S. businesses can’t take full advantage of Russia’s accession to the World Trade Organization, but the senators believe that the Magnitsky bill is needed to ensure the Russian government is not let off the hook for their deteriorating record on human rights, democracy, and the rule of law.

McFaul Pushes for Trade Status

The Obama administration will not support any human rights or democracy legislation in exchange for Congress repealing the 1974 Jackson-Vanik amendment, the U.S. envoy to Russia said in Washington on the eve of a gathering of U.S. ambassadors Tuesday.

U.S. Ambassador Michael McFaul spoke about relations with Russia, telling scholars at two think tanks that refusing to lift Jackson-Vanik would not make Russia more democratic.

“If you don’t believe me, ask Navalny,” Ambassador Michael McFaul said, referring to an open letter published on the blog of Vladimir Milov, leader of the Democratic Choice movement, on Monday evening. The letter, which was also signed by Alexei Navalny and other key opposition figures in Moscow, urged the United States to remove the largely symbolic Cold War trade restriction.

The signatories included organizers of demonstrations against President-elect Vladimir Putin who recognize the lagging enthusiasm of protesters but have found it nearly impossible to unite around a common policy agenda.

End of Jackson-Vanik Shouldn’t Be the End of Russian Accountability

Vladimir Putin’s brazen election fraud, conducted twice in the last few months, has put the Obama administration in an uncomfortable position politically. The administration touts its “reset” policy as a success, but with Russia’s recent attempts to shield Iran’s nuclear program and protection of Bashar al-Assad at the Security Council–not to mention the election-year efforts to stir up anti-Americanism–that policy is increasingly defined by American concessions to Russia.

The reset has also put its architect, current Ambassador to Moscow Michael McFaul, in the unenviable spot of having to defend his signature achievement. McFaul has a long and distinguished career writing about Russian democratization, and the inherently political job of a diplomat requires him to either excuse or ignore behavior by the Putin administration that he has been warning against all along. But the issue that put McFaul on the defensive is the Cold War-era Jackson-Vanik amendment, which punished the Soviet Union’s trade status for its restrictions on Jewish emigration.

U.S. must maintain way to press Putin regime on human rights

HAVING CAMPAIGNED on a platform of anti-Americanism, Vladi­mir Putin likely will be proclaimed the winner of Sunday’s presidential election in Russia, giving him a new six-year mandate — and likely inaugurating an era of unrest in a nation whose rising middle class rejects him. The United States, which has focused on cutting deals with Mr. Putin while largely ignoring his autocratic domestic policies, now has a clear interest in encouraging the emerging mass movement demanding democratic reform.

It’s therefore unfortunate that the Obama administration’s first initiative after Mr. Putin’s return to the presidency will be to lobby Congress to grant Russia permanent trade privileges. The problem is not the preferences, per se; it is the administration’s resistance to replacing an outdated protocol for pressing Moscow on human rights with one suited to this moment.

    It’s therefore unfortunate that the Obama administration’s first initiative after Mr. Putin’s return to the presidency will be to lobby Congress to grant Russia permanent trade privileges. The problem is not the preferences, per se; it is the administration’s resistance to replacing an outdated protocol for pressing Moscow on human rights with one suited to this moment.

    The White House is seeking the repeal of a 1974 law known as Jackson-Vanik, which links the trade preferences for Russia to free emigration. Repeal is logical for a couple of reasons: Russia, unlike the former Soviet Union, does not restrict the exit of Jews and others; and if the law is not removed, U.S. companies will be penalized after Russia enters the World Trade Organization later this year.

U.S.-Russian Trade Ties Face Some Political Snags

With relations between Russia and the United States on edge over Syrian policy and strident anti-American statements by the Russian government in response to political protests here, the Obama administration and its Democratic allies in Congress have begun an aggressive push to end cold-war-era trade restrictions and make Russia a full trade partner.

The seemingly incongruous and politically fraught campaign to persuade Congress to grant permanent, normal trade status reflects a stark flip in circumstances: suddenly, after more than 35 years of tussling over trade, Russia has the upper hand.

In December, Russia became the last major economy to win admission to the World Trade Organization — a bid that was supported by the Obama administration because it required Russia to bring numerous laws into conformity with international standards, including tighter safeguards for intellectual property. It was also part of the so-called reset in relations with the Kremlin.

But if Congress does not repeal the restrictions, adopted in 1974 to pressure the Soviet Union to allow Jewish emigration and now largely irrelevant, the United States will soon be in violation of W.T.O. rules. American corporations could be put at a serious disadvantage — paying higher tariffs, for instance, than European and Asian competitors, which would immediately enjoy the benefits of Russia’s new status.
