EUROPEAN PARLIAMENT TAKES A STANCE AGAINST ABUSE OF POWER IN RUSSIA
The European Parliament’s Foreign Affairs Committee today threw its weight behind the campaign to bring those to account who are responsible for the death of anti-corruption hero Sergei Magnitsky.
The Committee has proposed an EU-wide visa ban and assets freeze for Russian officials involved in Magnitsky’s death, and in its cover-up. The Members of the European Parliament added a call to Russia to conduct a thorough and impartial investigation into this case. The Committee expects the Council to take on a more coeherent human rights policy.
In November 2009, Russian lawyer Sergei Magnitsky died in prison. He had been held in detention for almost a year, after alleging wide-spread and systematic corruption and theft by government officials. The ensuing outrage at the brutality and injustice of his treatment led to an international campaign to bring those responsible to account.
In 2011 Magnitsky’s mother collected Transparency International’s Integrity Award on his behalf during the 14th International Anti-Corruption Conference (IACC). Commitment of Russian authorities to basic values remains the main prerequisite of EU-Russia relations: Jacek Protasiewicz MEP
“The commitment of Russian authorities to basic values such as the rule of law, human rights and fundamental freedoms remains the main prerequisite of EU-Russia relations and for the development of a stable and reliable partnership”, said Jacek Protasiewicz MEP, Vice-President of the European Parliament, commenting on today’s vote of the Foreign Affairs Committee on the Recommendation to the Council on establishing common visa restrictions for Russian officials involved in the Sergei Magnitsky case.
The main aim of this Report is to recommend to the EU Council the introduction of a visa ban and a policy of freezing assets against those responsible for prosecution and murder of Sergei Magnitsky. The Recommendation follows the adoption of the Sergei Magnitsky Law by the Foreign Affairs Committee of the US Senate as well as the adoption of numerous resolutions by several other European countries and international organisations. It has also gathered large support in the Parliament’s Committee.
“The Magnitsky case is one the most obvious and well documented cases of abuse of power and misuse of the judicial system by the Russian law enforcement authorities”, said Jacek Protasiewicz MEP, EPP Group Shadow Rapporteur.

Short note on the extraordinary delegation meeting regarding the case of Sergey Magnitsky
On the 26/5/11the Parliamentary Cooperation Committee EU-Russia invited Mr Browder of the Hermitage Capitel Management and Mr Wiegand, Director for Russia from the EEAS, to update the European Parliament on developments regarding the Magnitsky case. A short report of the meeting.
Sergey Magnitsky died in pre-trial last year after having discovered a large scale corruption scandal. Magnitsky, who believed in justice and who did not want to give on pressure from officials that were serving their own pocket, did not survive the bitter fight he started against the Russian bureaucratic system. He was a lawyer for the Hermitage. His colleagues were shocked and in despair when they heard about his death.
Mr. Browder, the director of Hermitage had his heart broken at the moment he got the news of his death. Since that day he has been fighting for the justice Magnitsky was fighting for.
Mr Wiegand set out the attempts by the EU to get clarification on the case. The EEAS welcomed the resolution by the EP of December last year. In the meantime the case is mentioned at high level meetings with Russian officials. Also Medvedev´s promise to support an official investigation in the case is considered as a positive step. Until no official outcome of the investigations has been published, the EEAS will refrain from taking measures against Russian officials as was laid out in the resolution.
Mr. Browder also expressed its full satisfaction with the resolution adopted by the EP. However he is very concerned about promotions and awards recently given to officials that were involved in the case and outlined a number of indications of the Russian authorities to denial any crimes convicted by authority officials in relation to the death of Sergey Magnitsky.
Mr. Browder asked specifically for actions taken against the 60 officials as was proposed in the EP resolution, he is also of the opinion that neither the independent, nor the official investigation will lead to conviction of officials. Restrictive and targeted measures, such as those proposed by the European Parliament in its resolution of 16 December 2010 with regard to the case of Sergey Magnitsky, have recently been the subject of much debate and were touched upon in discussions on the need to review EU Neighbourhood policy, in particular in the light of the sanctions imposed on Belarus by the Council on 31 January 2011 and the need to curtail the severe human rights violations currently taking place in Southern Europe.

Murder case puts pressure on EU-Russia diplomacy
EU diplomacy should be guided by basic moral imperatives and open parliamentary politics, not behind-closed-doors strategising, a prominent campaigner has said.
Bill Browder, a US-born British venture capitalist who a few years ago was the biggest foreign investor on the Russian stock market, is targeting the European Parliament and national EU assemblies to make the European Council impose sanctions on Russian officials.
Browder has put together a list of 60 people in the Russian interior ministry, justice system and the secret police, the FSB, who he says tortured and murdered his lawyer, Sergei Magnitsky, after he exposed their multi-million-euro tax scam.
On Monday (30 May), the Russian general prosecutor in a statement said one of the top men on the list, Oleg Silchenko, committed “no violations of federal law”, in what Browder’s side called an ongoing “whitewash” that “damages the credibility” of the Russian government.
Browder, who has published hard evidence of how the Russian officials scammed the Russian taxpayer, wants the EU to impose an asset freeze and travel ban on the men and women involved.
