Defense fails to get probe extended against penitentiary service employees blamed for Magnitsky death

Investigators have refused to extend the probe against the prison employees, accused of involvement in Hermitage Capital Foundation lawyer Sergei Magnitsky’s death.

“I requested an additional investigation, but my request has been rejected,” Nikolai Gorokhov, the defense lawyer for Magnitsky’s mother Natalya, told Interfax.

The files related to Larisa Litvinova, a doctor with the prison where Magnitsky died, and to Dmitry Kratov, the prison’s deputy head responsible for medical services, were detached from the main case related to Magnitsky’s death. The investigation into their cases was completed and the cases are to be referred to prosecutors who are to confirm the indictment. Litvinova is no longer prosecuted because her limitation period has expired. But Magnitsky’s relatives challenged this decision. Russian Investigative Committee spokesman Vladimir Markin announced in November 2011 that “Kratov’s and Litvinova’s prosecution was started on July 18, 2011, after a direct link was established between their actions and Hermitage Capital Lawyer Sergei Magnitsky’s death in prison in 2009.”

Magnitsky death inquiry prolonged once again – Hermitage Capital (Part 2)

MOSCOW. April 26 (Interfax) – The criminal investigation into the death of Hermitage Capital lawyer Sergei Magnitsky in a Moscow jail in 2009 has been prolonged once again, the investment advisory firm said in a press release, received by Interfax on Thursday.

As European Union countries and the United States discuss sanctions and other tough measures in relation to Russian officials standing behind the Magnitsky case, the Russian authorities have prolonged the inquiry into his death for the 12th time, it said.

Russian Investigative Committee officials have so far been unavailable for comment.

Russian Investigative Committee spokesman Vladimir Markin said in January that the investigation into the circumstances surrounding Magnitsky’s death had been prolonged until April 24.

Court refuses to include Human Rights Council’s report in Magnitsky case files

MOSCOW. April 16 (Interfax) – Moscow’s Ostankinsky District Court has upheld prosecutor’s refusal to take into consideration the conclusions set forth by the presidential Council for Civil Society and Human Rights in the tax evasion case against Hermitage Capital lawyer Sergei Magnitsky.

Earlier, Magnitsky’s relatives petitioned to add the Council’s report to the case files.

Igor Vasin, a lawyer for Magnitsky’s family, who filed the petition on the relatives’ behalf, insisted that the report mentions persons who investigated criminal charges against Magnitsky but who were directly interested in a certain outcome of the case.

Prosecutor Boris Kibis argued that the report was irrelevant because it had nothing to do with the tax evasion charges.

Having heard the arguments presented by the sides, the judge ruled against the report.

The court also rejected lawyer Vasin’s request to replace the prosecutor.

Magnitsky memorial meeting held in Moscow

Several dozen people got together in Moscow on Sunday to mark the 40th birthday of Sergei Magnitsky, a lawyer for British hedge fund Hermitage Capital who died in jail in 2009 after being denied essential medical assistance.

Those present were shown a film about Magnitsky’s life and death, and many of them took the floor, Solidarnost (Solidarity) opposition coalition spokeswoman Olga Shorina told Interfax.

Those who attended the event included Magnitsky’s mother, Natalya Magnitskaya, People’s Freedom Party (PARNAS) Co-Chairman Boris Nemtsov, and rights defender Valery Borshchev.

Magnitsky, who had his birthday on April 8, was charged with tax evasion. He died in a detention center in Moscow on November 16, 2009. Later a criminal investigation was launched into his death.

Russian party leader, rights activist doubt Magnitskiy case will be investigated

The discontinuation of criminal proceedings against Butyrskiy remand centre doctor Larisa Litvinova in the case of the death of Hermitage Capital lawyer Sergey Magnitskiy is unacceptable, Russian opposition party Yabloko leader Sergey Mitrokhin has said, as reported by the Russian news agency Interfax on 9 April.

Mitrokhin said: “This is unacceptable not only because this is a loud case but also because this is the government’s crime against a citizen. If such cases are closed so easily, then this means that criminals are simply being shielded.”

Mitrokhin added: “Objective justice does not exist in our country. If interests of large officials are involved, then the justice system works for them and this case, most likely, will not be investigated and none of the guilty will go to jail since officials are involved in it.”

Meanwhile, a member of the presidential human rights council and head of the National Anti-Corruption Committee Kirill Kabanov said that the Magnitskiy investigation was being wrapped up and that certain people were hoping to close the case when Putin takes the presidency.

Moscow single-person pickets to protest against Magnitsky case resumption

One-person pickets will be staged outside the Russian Interior Ministry on March 24 in protest over the re-opening of a criminal case against Hermitage Capital lawyer Sergei Magnitsky, who died in a Moscow jail in 2009, For Democratic Russia committee activist Natalya Pelevina told Interfax.

Pelevina said that City Hall recently rejected her application for permission to hold a rally against such steps.

“Following City Hall’s denial, we decided to hold single-person pickets to protest against police arbitrariness in Sergei Magnitsky’s case. We will come to the Interior Ministry building in Moscow on March 24,” she said.

Two tax officials accused of embezzlement by Magnitsky out of Russia – FSB report in court

Two former tax service officials whom Sergei Magnitsky, a Hermitage Capital lawyer, suspected shortly before dying at a Moscow prison of embezzling about 5.4 billion rubles from the budget, have left Russia.

This information became known at a Tuesday session of the Basmanny District Court hearing an appeal by Magnitsky’s colleague, Jamison Firestone, against investigators’ inaction.

Firestone, in particular, complained that law enforcement bodies failed to detain tax service officials Olga Tsaryova and Yelena Anisimova to probe their possible involvement in the embezzlement scheme.

A report presented at the court by the Federal Security Service (FSB) says that Tsaryova and Anisimova had left Russian territory, and therefore an investigator could not present them with summons to take part in a pretrial investigation.

Magnitsky’s mother accuses investigators of repression

Natalya Magnitskaya, the mother of Hermitage Capital lawyer Sergei Magnitsky, who died in a detention facility in Moscow in 2009, has asked the Interior Ministry to stop summoning her for questioning because it is causing her suffering, the press service for Hermitage Capital said.

“Yesterday, Sergei Magnitsky’s mother sent a statement to the Interior Ministry saying the Interior Ministry has been subjecting [Sergei Magnitsky’s] closest relatives to emotional torture for the past six months, trying to cause them to sign statements refusing his rehabilitation,” the press service for Hermitage Capital told Interfax.

The source said the complaint, which is addressed to S. Solovyov, the head of the Interior Ministry’s Investigations Unit for the Central Federal District, states that “the illegal investigative measures are causing me and the closest relatives of my son emotional suffering.”

Magnitsky’s case will be sent to court immediately after defense lawyers study it – source (Part 2)

The tax evasion case of Sergei Magnitsky, a Hermitage Capital hedge fund lawyer who died in a Moscow jail in 2009, will be sent to court immediately after the defense of the late lawyer examines it, a source at the Russian Interior Ministry told Interfax on Friday.

“The pre-trail investigation is over. The case will be sent to court as soon as defense lawyers examine it,” the source said.

Posthumous proceedings against Sergei Magnitsky will be passed over to a court as Magnitsky’s legal representatives “refuse to consent to the termination of the criminal proceedings against him,” the Interior Ministry said on Tuesday.
