Russian rights activists want list of suspects of lawyer’s death to be extended

Moscow, 24 August: Human rights activists hope that investigators will manage to identify all those guilty of Hermitage Capital fund lawyer Sergey Magnitskiy’s death in a Moscow remand centre.
The Investigations Committee extended the term of the investigation of the criminal case of Magnitskiy’s death until 24 November.
“We would like to hope that the extension of the probe will be justified in terms of bringing to justice all those guilty [of the incident],” Tatyana Lokshina, deputy head of the Moscow office of Human Rights Watch, has told Interfax news agency.

Charges in Magnitsky case brought against scapegoats – Hermitage Capital
The Hermitage Capital fund regards the announcement of the Russian Investigative Committee that charges were brought against a doctor of Butyrka detention facility Larisa Litvinova, and deputy chief of the facility Dmitry Kratov as clearly insufficient and indicating the restriction of the list of persons responsible for the death of Sergei Magnitsky.
“These are only two persons out of 60 included in the Cardin List of persons involved in the illegal arrest and persecution of Sergei Magnitsky and the large-scale embezzlement of budget funds by Interior Ministry and the tax officials he had exposed,” a statement of Hermitage Capital obtained by Interfax says.

Russia: Charges against Magnitskiy case doctors see mixed response
Medical officers Larisa Litvinova and Dmitriy Kratov from the Butyrka pre-trial detention centre have been charged with the manslaughter of Hermitage Capital fund lawyer Sergey Magnitskiy, the privately-owned Interfax news agency reported on 12 August. They are said to have been negligent in providing care to Magnitskiy before his transfer to the Matrosskaya Tishina remand centre, where he later died.
Litvinova and Kratov were among those identified by rights activists as being complicit in Magnitskiy’s death. The Russian rights activists, who were involved in the independent probe, have not responded with a great deal of enthusiasm, expressing concern that charges against Litvinova and Kratov will become something of a smoke screen.

Rights activists skeptical about Interior Ministry reshuffles

Leading Russian human rights activists believe the recent reshuffles in the leadership of the Interior Ministry announced by President Dmitry Medvedev are not a sign of a thorough reform of the Russian law enforcement institutions.
“This looks more like an outbreak of some intra-clan rivalry rather than a real reform of the Interior Ministry,” Lev Ponomaryov, the leader of the organization For Human Rights, told Interfax on Saturday in commenting on the reshuffles.
“I am sure that a real reform should begin with the interior minister,” Ponomaryov said.

Heritage protests Chaika’s participation in Magnitsky case investigation

Representatives of the investment fund Hermitage Capital believe the probe conducted by the Prosecutor General’s Office into the criminal cases involving the activities and death of Hermitage Capital auditor Sergei Magnitsky will not yield results.
“The Prosecutor General’s Office has been asked to increase procuratorial supervision, which has been and still remains non-existent. It’s absence led to the inhuman arbitrariness that led to Sergei Magnitsky’s persecution by the officials whom he found to have committed crimes, which lasted for a year, and his death in a detention facility,” Hermitage Capital said in a statement received by Interfax on Wednesday.
The statement alleges that officials from the Prosecutor General’s Office have failed to take measures to stop “illegal actions taken by officials in the Magnitsky case” for 3.5 years.
“In the course of the 12 months spent by Sergei Magnitsky in a detention facility, over 20 complaints were filed with the Prosecutor General’s Office alleging violations of his rights and illegal actions taken by investigators and Interior Ministry officials. All those complaints were either illegally declined or left without a response by the Prosecutor General’s Office,” Hermitage said.
Hermitage Capital recalled that Magnitsky filed an appeal contesting Yury Chaika’s actions as “illegal and violating his [Magnitsky’s] constitutional rights” on August 17, 2009.
“The complaints filed by Magnitsky’s lawyers to Yury Chaika on September 11, 2009, alleging illegal prosecution of an innocent person, physical and psychological pressure to break his will, and denial of medical assistance and surgery was also declined,” the statement says.
For this reason, “Magnitsky’s colleagues are protesting the continuing participation by Prosecutor General Yury Chaika in the investigation into the Magnitsky case.”

U.S. senator proposes expansion of “Magnitsky list”

U.S. Senator Benjamin Cardin has suggested that the names of the Russian officials who failed to take measures against the officials responsible for the death of auditor Sergei Magnitsky should be added to the so-called Magnitsky list, Hermitage Сapital has reported.
“Today Senator Benjamin Cardin has submitted to the U.S. Senate an expanded draft of the bill on Sergei Magnitsky,” Hermitage Capital said in a report obtained by Interfax on Friday.

Some EU countries ready to impose sanctions on Russian officials who could be involved in Magnitsky case

Some EU countries are considering introducing sanctions on Russian officials who could be responsible for the death of Hermitage Foundation lawyer Sergei Magnitsky.
“The foreign ministers of some EU countries are ready to take practical measures and decisions in this area,” European Parliamentarian Heidi Hautala told a press conference at the Interfax central office on Monday.
The statement on the possible sanctions made in the European parliament became a powerful signal to the entire EU to take decisive measures, she said.

Hermitage Capital urges Russian authorities to conduct transparent trial

Jamison Firestone, the former boss of Hermitage Capital fund lawyer Sergey Magnitskiy [who died in Russian custody], has asked the Russian Prosecutor-General [Yuriy Chayka] and the head of the Russian Investigations Committee [Aleksandr Bastrykin] to conduct an open trial against Vyacheslav Khlebnikov, who figures in the case relating to embezzlement.
“J. Firestone demanded that the Prosecutor-General’s Office refuse Khlebnikov’s appeal, which is supported by the Interior Ministry, to conduct the trial in a ‘special’ (reduced) manner, without any examination of the evidence in court,” says a statement from the fund received by Interfax today.
