U.S. Senate May Discuss Magnitsky Sanctions in April

The U.S. Senate Committee on Foreign Relations may discuss in April a 2011 bill to impose sanctions on Russian officials implicated in the detention death of Hermitage Capital lawyer Sergei Magnitsky, the committee’s chairman John Kerry said.

“I’d like to try to put it on a business meeting for when we return [from the April 2 – April 13 recess], and we should aim to do it,” Kerry said.

Senator Benjamin Cardin introduced the “Sergei Magnitsky Rule of Law Accountability Act of 2011” last May, but no legislative action has been taken on it so far. U.S. ambassador to Russia Michael McFaul said it was redundant as the U.S. already compiled a blacklist of Russian officials linked to Magnitsky’s death, who are subject to a travel ban and asset freeze.

Cardin said his bill should be passed simultaneously with discussions on the abolishment of the Jackson-Vanik amendment, an American piece of legislation from 1974 that introduced economic sanctions against the Soviet Union.

Russia Slams Sweden over Magnitsky List

Russian diplomats denounced the call by Swedish lawmakers for a Europe-wide blacklist of Russian officials implicated in the prison death of whistleblowing lawyer Sergei Magnitsky.

The proposal is “an unfriendly step against Russia, an attempt to interfere in internal affairs of another state and a disrespect of the concept of its Judiciary’s independence,” the Russian Embassy in Stockholm said in a press release on Friday.

The check into the death of Magnitsky, who died in 2009 after 11 months in pretrial detention of health problem and, allegedly, a beating by prison guards, is still ongoing, the embassy said.

The “politicized initiative … has nothing to do with genuine concern about human rights” and should not be supported by the Swedish parliament, the Riksdag, or the country’s government, the embassy said.

Fifty-nine of 349 Riksdag members have petitioned their government earlier to blacklist dozens of Russian officials linked to Magnitsky’s case for European Union entry and freeze their assets in Europe. Lavrov Dismisses Magnitsky Sanctions as ‘PR Stunt’

The recent steps by western countries introducing travel bans against Russian officials linked to the high-profile death of lawyer Sergei Magnitsky in 2009 are nothing but a PR stunt, Russian Foreign Minister Sergei Lavrov said on Wednesday.

Magnitsky, who was detained after accusing officials of fraud, reportedly died due to torture and neglect. Two doctors were charged over his death in August last year.

“In line with international law, any country can refuse issuing a visa to anyone from any other country without giving any explanations. That is why all of this is to a large extent a pure PR stunt to show off how ‘cool’ we are. We are making lists and will not let anyone in,” Lavrov said.

U.S. Reiterates Demand for Justice in Magnitsky Case

Days after Russian authorities decided to try lawyer Sergei Magnitsky posthumously, the U.S. Department of State reiterated its calls to bring those guilty for his death in detention to justice.

Investigators of the Interior Ministry said on Tuesday they were ready to submit the case of the late Sergei Magnitsky, a Hermitage Capital auditor, and Hermitage Capital CEO William Browder to court.

“Pursuing criminal charges against Sergei Magnitsky serves no purpose other than to deflect attention away from the circumstances surrounding this tragic case,” office of the spokesperson said in a statement.

“We’ve seen the press reports about the reopening of the Magnitskiy case,” Department of State Spokeswoman Victoria Nuland told a press briefing earlier in the day. “We continue to call for Russian authorities to bring those responsible for Sergei Magnitskiy’s death to justice.”

Russian Authorities Are Continuing Their Trial Against A Hedge Fund Lawyer — Even Though He Already Died In Prison

Sergei Magnitsky, a lawyer for Hermitage Capital, tragically died in Russian custody in 2009, and a somewhat official report last year found that police torture contributed to his death.
However, despite his death, Magnitsky is still on trial.

Ria Novosti reports that the Russian Interior Ministry have told the Magnitsky family that they have concluded an initial investigation and they were ready to submit the case against the late Magnitsky to court.

Magnitsky had been arrested for tax evasion shortly in 2008, not long after he had accused tax and police officials of carrying out a hefty $230-million tax scam. The CEO of Hermitage Capital, William Browder, also faces charges but had fled the country. The case against Browder had reached the statute of limitations but now appears to have been reopened.

UK MP wants to bar Russian officials from London Olympics

UK Member of Parliament Denis MacShane called for barring a number of Russian officials from attending the 2012 Summer Olympics in London.

MacShane addressed parliament on Wednesday with a report on human rights in Russia, including the case of lawyer Sergei Magnitsky, who died in pre-trial detention two years ago.

MacShane challenged Prime Minister David Cameron to follow the example of Margaret Thatcher, who in 1980 headed the campaign to boycott the Moscow Olympics in protest over the Soviet invasion of Afghanistan.
“In 1980, Mrs. Thatcher had the guts to say no to a formal British endorsement of the Moscow Olympics,” MacShane said.

Human Rights court awards damages to sick Russian prisoners

The European Court of Human Rights has awarded three seriously ill Russian remand prisoners a total of 38,000 euros following lawsuits against the Russian authorities for poor treatment in pretrial detention centers, according to a ruling published on the court’s website on Tuesday, RAPSI news agency reported.

The issue of poor medical treatment in Russian pretrial detention centers has become increasingly controversial following the high-profile deaths in custody of Hermitage Capital Management fund legal adviser Sergei Magnitsky in November 2009 and Vera Trofimova, a defendant in a fraud case, in April 2010.
The Strasbourg court said the petition was filed by Armen Arutyunyan, Teymuraz Sakhvadze and Vladimir Vasilyev, who were charged with serious crimes including murder and attempted rape.

Magnitsky was tortured in prison – Hermitage Capital

Hermitage Capital investment fund on Monday released an in-depth and documented report accusing Russian officials of the false arrest, torture and pre-trial death of its auditor Sergei Magnitsky and the subsequent cover-up by Russian officials.

“Most shockingly, this report proves that nearly every high level Russian official in the law enforcement system publicly lied to cover up the fact that he was systematically denied medical care for a life threatening illness,” Hermitage Capital said in a press release.

Magnitsky was arrested and jailed without trial in November 2008 and died in police custody a year later after being denied medical care. The 37-year-old lawyer had accused tax and police officials of carrying out a hefty $230-million tax scam.

Russia transfers gravely ill inmate to hospital after Strasbourg ruling

A gravely ill inmate, Natalia Gulevich, whose kidneys and bladder recently failed was transferred on Tuesday from a pretrial detention center to a hospital after the Strasbourg Court of Human Rights issued a ruling, her lawyer, Anna Stavitskaya, said.

“Gulevich was today transferred to a hospital! The EU’s persistence [Strasbourg court ruling] and a kidney failure was necessary for this! Without it our officials believed that the individual was healthy,” Stavitskaya said on her Facebook page.
