Preliminary hearings of Browder and Magnitsky tax case due at Tverskoy court
Moscow’s Tverskoy district court on Monday will have preliminary hearings of the tax-evasion case of the head of Hermitage Capital investment fund William Browder and the late lawyer of the fund Sergei Magnitsky.
The sides will file their motions after which the date of hearing of the merits of the case will be set. The interests of the sides will be represented by appointed attorneys Nikolai Gerasimov and Kirill Goncharov. They were given time until March 4 to examine the findings of the case.
The lawyer of Magnitsky mother, Natalia Magnitskaya, before the beginning of the Feb. 18 session read out for the press her message to the judge of Tverskoy court saying that she finds the trial illegal and the relaunching of criminal persecution after her son’s death without a corresponding application from the family cynical.
“I am not authorizing anyone to represent the interests of my son in Tverskoy court. The person who assumed this duty will be acting contrary to his interests,х” the statement says.

Magnitsky’s mother complaint over case resumption dismissed
The Moscow City Court has upheld the lower-court’s dismissal of a complaint filed by the mother of Sergei Magnitsky, a legal consultant who died in the pre-trial detention center, the Russian Legal Information Agency (RAPSI) reports from the courtroom.
The woman requested to cancel the decision to resume the criminal case against her son.
“The Tverskoy District Court’s decision to dismiss the complaint is legal and founded,” a judge of the cassation board said.
Magnitsky, 37, who was accused of corporate tax evasion in relation to his work for the Hermitage Capital investment fund, died in an isolation ward in November 2009. According to the Prosecutor General’s Office, his death was caused by cardiovascular insufficiency.
His death evoked a major public outcry.
The criminal case against Magnitsky was terminated by the Investigative Committee due to his death, but the Prosecutor General’s Office decided to resume the investigation.

Russia’s Vacation from Justice
Russian officials have a selective approach to holidays. When it came to arresting opposition leader Boris Nemtsov on New Year’s Eve and sentencing him on January 2 (a Sunday), no effort was spared. Yet when it came to hearing his appeal, Tverskoy Court remembered that January 1 to 10 is a period of vacation. By law, an appeal against administrative arrest must be heard within 24 hours. The former deputy prime minister has been in detention since December 31, but his appeal has still not been reviewed due to “holidays.” The latest attempt to submit it to court, on January 8, ended with Mr. Nemtsov’s lawyer, Timur Onikov, being escorted out by bailiffs. On January 11, the appeal was admitted as a priority case — by the European Court of Human Rights in Strasbourg.
